Artikel 45 Ermessensnachprüfung durch den Gerichtshof
Nach Artikel 261 AEUV hat der Gerichtshof die Befugnis zu unbeschränkter Ermessensnachprüfung von Beschlüssen, mit denen die Kommission Geldbußen oder Zwangsgelder verhängt hat. Er kann die verhängten Geldbußen oder Zwangsgelder aufheben, herabsetzen oder erhöhen.
