Art. 2 Organisatorische Vorkehrungen für die Fortführung des Geschäftsbetriebs | RTS on continuity and regularity | MiCA

This article establishes the governance and ownership requirements for the business continuity policy that crypto-asset service providers must maintain under Regulation (EU) 2023/1114.

It places clear and direct accountability on the management body of the crypto-asset service provider, making it responsible not only for establishing and endorsing the policy but also for its ongoing implementation and effectiveness.

The article also addresses the internal dissemination of any changes to the policy.

Ensure your business continuity policy is comprised of plans, procedures, and measures, as established and endorsed by the management body.
The management body is responsible for implementing the policy and reviewing its effectiveness at least on an annual basis.
Transmit any modifications to the business continuity policy to all relevant internal staff through effective communication channels.

1. Die in Artikel 68 Absatz 7 der Verordnung (EU) 2023/1114 genannte Strategie für die Fortführung des Geschäftsbetriebs umfasst Pläne, Verfahren und Maßnahmen.

Das Leitungsorgan des Anbieters von Kryptowerte-Dienstleistungen erstellt und billigt in Wahrnehmung seiner in Artikel 68 Absatz 6 der Verordnung (EU) 2023/1114 genannten Aufgaben die Pläne, Verfahren und Maßnahmen, aus denen sich die Strategie für die Fortführung des Geschäftsbetriebs zusammensetzt. Das Leitungsorgan des Anbieters von Kryptowerte-Dienstleistungen verantwortet die Umsetzung der Strategie für die Fortführung des Geschäftsbetriebs und überprüft mindestens einmal jährlich ihre Wirksamkeit.
1. Anbieter von Kryptowerte-Dienstleistungen stellen sicher, dass jegliche Änderungen der Strategie für die Fortführung des Geschäftsbetriebs allen betroffenen internen Mitarbeitern über wirksame Kommunikationskanäle mitgeteilt werden.
