Article 65 Establishment and structure of the European Artificial Intelligence Board

Summary What does Article 65 of the AI act regulation say?

This is the foundational article establishing the European Artificial Intelligence Board, a key governance body under the regulation.

It sets out the Board's composition, membership rules, internal organisation, and operational structure.

The Board is made up of one representative per Member State, with the European Data Protection Supervisor attending as an observer and the AI Office attending without voting rights.

The article links directly to Article 66, which defines the Board's actual tasks and advisory functions — Article 65 is purely about setting the body up rather than what it does.

Important points:

  • Member States are required to ensure their Board representatives hold the necessary competences and powers, serve as a single contact point, and can coordinate national competent authorities on implementation.
  • The Board must establish two standing sub-groups covering market surveillance and notified bodies respectively, with the market surveillance sub-group acting as the administrative cooperation group under Regulation (EU) 2019/1020.
  • The AI Office provides the secretariat for the Board, convenes meetings at the Chair's request, and prepares the agenda, but has no voting rights.
