Article 18 Procedure to issue qualified alerts

Summary What does Article 18 of the Scientific panel of independent experts say?

This article sets out the procedural requirements for the scientific panel to issue qualified alerts to the AI Office.

It establishes the internal decision-making threshold required before an alert can be sent, sets minimum content standards for those alerts, and places an obligation on the AI Office to provide the technical infrastructure through which alerts are managed.

It connects directly to Article 90 of Regulation (EU) 2024/1689, which governs the qualified alert mechanism more broadly, and to Article 8 of this Regulation, which allows the scientific panel to further refine these procedures through its rules of procedure.

Important points:

  • A simple majority of the scientific panel's members must agree before a qualified alert can be issued to the AI Office.
  • Qualified alerts must be duly reasoned and meet the minimum content requirements set out in Article 90(3) of Regulation (EU) 2024/1689.
  • The AI Office is required to provide a dedicated secure interface supporting the sending, withdrawal, correction, modification, and closing of qualified alerts.
