Article 19 Handling of qualified alerts

Summary What does Article 19 of the Scientific panel of independent experts say?

This article deals with what happens after the scientific panel issues a qualified alert to the AI Office, effectively describing the downstream response process.

It establishes the AI Office as the decision-making body that evaluates each qualified alert and determines whether to act or close it.

The article connects directly to Article 18, which governs how the scientific panel issues qualified alerts, and feeds into the broader enforcement framework of Regulation (EU) 2024/1689 by triggering potential investigative or supervisory measures against providers of general-purpose AI models.

Important points:

  • The AI Office is required to evaluate qualified alerts and decide whether to launch measures or close the alert, within two weeks of receiving a complete qualified alert.
  • The AI Office must inform the Board before launching any measures, and may request additional information from the scientific panel, which pauses the two-week processing clock until that information is provided.
  • Where the AI Office decides to launch measures, the Secretariat, in consultation with the Chair of the scientific panel, shall appoint a rapporteur and two contributors to advise the Commission on the adoption of those measures.
