Summary What does Article 59 of the Sixth anti-money laundering (AML 6) directive say?

This article is a short but important transparency and coordination provision that directly supports the sanctions framework established in the preceding articles of this section.

It creates a dual reporting and publication mechanism: supervisors must report sanctions and administrative measures upward to AMLA, and AMLA in turn serves as a central hub by maintaining public links to each supervisor's own publications.

Where a sanctioned entity operates across multiple Member States, the relevant information must also flow laterally between supervisors.

  • Supervisors are required to inform AMLA of all pecuniary sanctions and administrative measures imposed, including any appeals and their outcomes.
  • Where a sanction or measure concerns an entity operating in two or more Member States, that information must also be shared with the other supervisors involved.

    1. Member States shall ensure that their supervisors and, where relevant, the public authority overseeing self-regulatory bodies in their performance of supervisory functions, inform AMLA of all pecuniary sanctions imposed and administrative measures applied in accordance with this Section, including of any appeal in relation thereto and the outcome thereof. Such information shall also be shared with other supervisors when the pecuniary sanction or administrative measure concerns an entity operating in two or more Member States.

    1. AMLA shall maintain on its website links to each supervisor’s publication of pecuniary sanctions imposed and administrative measures applied in accordance with Article 58, and shall show the period for which each Member State publishes pecuniary sanctions and administrative measures.
