Article 108 Entry into force and application
Summary What does Article 108 of the Anti-money laundering authority regulation (AMLAR) say?
This is the entry into force and application article, which sets out the timeline for when this Regulation becomes legally effective and when its various provisions must be observed.
It establishes a staggered application schedule, meaning that while the Regulation enters into force shortly after publication, different groups of articles become applicable at different points in time.
The bulk of the Regulation applies from 1 July 2025, but a defined set of articles — primarily those relating to the Authority's governance structure, its establishment, and its technical standard-setting powers — apply earlier, from 26 June 2024, allowing the Authority to be set up and operational ahead of the main application date.
Important points:
- The Regulation enters into force on the seventh day after publication in the Official Journal of the European Union.
- The main body of the Regulation applies from 1 July 2025, but foundational governance and structural articles apply from 26 June 2024 to enable the Authority's establishment.
- Article 103, which amends Regulation (EU) No 1093/2010, applies from 31 December 2025.
