Article 56 Notifications

Summary What does Article 56 of the Anti-money laundering regulation (AMLR) say?

This is a short procedural article that sits within the broader beneficial ownership transparency framework of the regulation.

It creates a reporting obligation for Member States to notify the Commission of the types of legal entities under their national law, linking directly to the beneficial ownership identification rules established in Articles 51 and 52(4).

The article is essentially a coordination mechanism, ensuring the Commission and other Member States have visibility into how each national legal system categorises entities for beneficial ownership purposes.

Important points:

  • Member States are required to notify the Commission by 10 October 2027 with a list of legal entity types, their characteristics, legal basis, and whether the fallback mechanism under Article 63(4) applies.
  • The Commission must then communicate each Member State's notification to all other Member States, creating a shared information base across the Union.
  • Notifications must include a detailed justification where the Article 63(4) mechanism applies, meaning this is not a simple administrative filing for those cases.

Springlex's summary of the article, a reading aid, not a substitute for the legal text.

  1. Each Member State shall notify to the Commission by 10 October 2027 a list of the types of legal entities existing under its national law with beneficial owners identified in accordance with Article 51 and Article 52(4). That notification shall include the specific categories of entities, description of characteristics and, where applicable, legal basis under the national law of the Member State concerned. It shall also include an indication of whether, due to the specific form and structures of legal entities other than corporate entities, the mechanism under Article 63(4) applies, accompanied by a detailed justification of the reasons for that.

  2. The Commission shall communicate the notification referred to in the first paragraph to other Member States.
