Summary What does Article 8 of the ITS on cooperation for the purposes of direct supervision say?
This article follows directly from Article 7, which covers the notification of selected obliged entities and their right to request a substantive review.
Article 8 deals with what happens next: the public disclosure of the final list of selected obliged entities on the Authority's website, once the review process has concluded.
It also sets out what that published list must contain and how long it must remain accessible.
Important points:
- The Authority is required to publish the list of selected obliged entities only after the time limit for substantive review requests has expired and any outcomes have been accounted for.
- The published list must name entities alphabetically, state when direct supervision begins, and confirm that the selection decision is appealable before the General Court of the Court of Justice of the European Union.
- The Authority must keep this published information accessible on its website for at least six years.
