Summary What does Article 6 of the ITS on FIU reporting to the EPPO say?

This article governs how FIUs must communicate the permitted use of the information they report to the EPPO.

Building directly on Articles 3 and 4, which establish the reporting template FIUs are required to use, Article 6 requires FIUs to use that same template to specify the conditions under which the reported information may be used — ranging from unrestricted use to specific limitations such as judicial purposes, intelligence purposes, or cooperation in criminal matters.

Where restrictions are applied, FIUs are generally expected to provide an explanation, with an exception carved out for situations where confidentiality prevents them from doing so.

Important points:

  • FIUs must indicate the permitted use of reported information within the designated fields of the reporting template.
  • Four specific categories of permitted use are available, along with an option to indicate other expressly stated restrictions.
  • FIUs are required to explain any restrictions on use they apply, unless confidentiality constraints prevent them from doing so.

Springlex's summary of the article is a reading aid, not a substitute for the legal text.
