Summary What does Article 9 of the ITS on FIU-to-FIU exchanges say?
This brief article sets out the procedural obligation on Financial Intelligence Units (FIUs) when handling Cross-Border Reports (XBRs).
It acts as a companion to Article 2, which defines what an XBR is, and connects directly to the broader framework established in Article 31 of Directive (EU) 2024/1640.
In essence, it confirms that FIUs do not simply pass on reports automatically — they must first apply defined selection criteria before forwarding, and must do so in accordance with the formatting instructions laid down in Annex V of this Regulation.
Important points:
- FIUs are required to apply the selection criteria from Commission Delegated Regulation (EU) 2027/XXXX before transmitting a Cross-Border Report.
- Follow the instructions in Annex V when forwarding Cross-Border Reports.
- This article operationalises the XBR concept defined in Article 2, linking the definition to a concrete transmission procedure.
Springlex's summary of the article is a reading aid, not a substitute for the legal text.
