Summary What does Article 25 of the RTS on customer due diligence say?
This article sits within the enhanced due diligence framework, directly supporting Article 34(4), point (a), of Regulation (EU) 2024/1624.
It sets out the additional information that obliged entities must gather when enhanced due diligence applies, specifically aimed at deepening their understanding of the customer and any beneficial owners.
Rather than prescribing a single fixed dataset, the article gives obliged entities a degree of flexibility, requiring them to obtain information sufficient to achieve one of three outcomes: confirming the accuracy of existing customer data, assessing reputational factors, or conducting a thorough ML/TF risk assessment of the customer and their known relationships.
Important points:
- Obtain additional information on customers and beneficial owners beyond standard due diligence requirements when enhanced due diligence applies.
- The additional information gathered must serve at least one of three purposes: verifying authenticity and accuracy of held information, assessing reputation, or identifying and assessing ML/TF risks comprehensively.
- The scope of risk assessment extends beyond the customer and beneficial owners to include close relationships known to the obliged entity or publicly known.
