    1. Where the parent undertaking in the Union or an obliged entity with branches or subsidiaries located in third countries identifies that the law of a third country does not permit or restricts the application of Regulation (EU) 2024/1624, it shall at least perform the following minimum actions:

      1. inform the supervisor without undue delay, and, in any case no later than 28 calendar days from the identification of the legal impediment, of the following:

        1. the name of the country concerned;

        2. how the application of the law of the third country concerned does not permit or restricts the application of Regulation (EU) 2024/1624

      2. ensure that those branches or subsidiaries require their customers and, where applicable, their customers’ beneficial owners, to provide consent to overcome the restrictions or prohibitions referred to in point (a), to the extent that this is compatible with the law of the third country and Regulation (EU) 2024/1624.

    1. In cases where the consent referred to in point (b) of paragraph 1 is not feasible, the parent undertaking or the obliged entity shall ensure that the branch or subsidiary established in the third country applies additional measures as set out in points (a) to (l) of Article 8 of this Regulation.

    1. Where the parent undertaking in the Union or an obliged entity cannot effectively manage the money laundering and terrorist financing risks by applying the measures referred to in paragraph 2, it shall ensure that the branch or subsidiary established in the third country implements such additional measures as necessary, appropriate and proportionate to effectively manage those legal impediments.

    1. The parent undertaking in the Union or the obliged entity shall select and determine the extent of the additional measures referred to in paragraphs 2 and 3 using a risk-based approach, shall without undue delay inform the supervisor of the additional measures taken and shall provide an assessment of their appropriateness in view of the money laundering risks, terrorist financing risks and the risk of the non-implementation or evasion of targeted financial sanctions.
