Summary What does Article 1 of the RTS on home-host supervisory cooperation say?

This is the foundational scoping article of the Regulation, establishing its purpose and the entities it governs.

It sets out that the Regulation defines the respective duties of home and host Member State supervisors when overseeing credit institutions, financial institutions, and non-financial sector obliged entities that belong to a group operating across multiple Member States.

Rather than detailing precise obligations, it maps out the three broad categories of cooperation that the rest of the Regulation will build upon: information exchange, conducting or facilitating inquiries, and coordinated supervisory approaches.

Important points:

  • Home and host Member State supervisors are the primary subjects of this Regulation, with duties applying specifically in the context of cross-border group supervision.
  • The Regulation covers three pillars of supervisory cooperation: information exchange, inquiry support, and coordinated supervisory activities.
  • The information exchange provisions apply without prejudice to rules governing AML/CFT supervisory colleges, signalling that separate frameworks may apply in those cases.

Springlex's summary of the article is a reading aid, not a substitute for the legal text.
