Summary What does Article 5 of the RTS on home-host supervisory cooperation say?
This article establishes the proactive information-sharing duties of the home Member State supervisor toward host Member State supervisors.
Rather than waiting to be asked, the home supervisor is required to act on its own initiative when it holds information that could materially affect how a host supervisor assesses the risk exposure of an obliged entity operating in its territory.
The article complements Article 6, which sets out the mirror obligation running in the opposite direction, from host to home supervisors.
Beyond the mandatory proactive disclosures, the article also provides a secondary channel covering additional information that may be shared either on request or voluntarily.
Important points:
- Home Member State supervisors are required to proactively share information with host Member State supervisors where it could significantly influence risk assessments of an obliged entity.
- Certain information, specifically that relating to sanctions or administrative measures, must be shared before the obliged entity is notified of the initiation of such proceedings.
- Home Member State supervisors may also share additional information — such as planned supervisory activities and risk reports — either on their own initiative or upon request.
Springlex's summary of the article is a reading aid, not a substitute for the legal text.
