Summary What does Article 6 of the RTS on home-host supervisory cooperation say?
Article 6 is the counterpart to Article 5, but from the perspective of the host Member State supervisor rather than the home Member State supervisor.
Where Article 5 sets out what home supervisors must proactively share, this article establishes the equivalent obligation for host supervisors, requiring them to share information on their own initiative when it could significantly influence the risk assessment of an obliged entity operating within their jurisdiction.
Beyond this proactive duty, the article also creates a broader obligation to share other relevant information either on request or voluntarily, covering items such as planned supervisory activities and risk reports.
Important points:
- Host Member State supervisors are required to proactively share information with home supervisors or other host supervisors when it could significantly affect the assessment of an obliged entity's risk exposure.
- Certain information, specifically that relating to the initiation of sanctions or administrative measures, must be shared before the obliged entity itself is notified.
- Host Member State supervisors must also provide additional information — such as recent supervisory activities and risk reports — either on request or on their own initiative, subject to the conditions of Article 46(3) of Directive (EU) 2024/1640.
Springlex's summary of the article is a reading aid, not a substitute for the legal text.
The supervisor of a host Member State shall provide on its own initiative to the supervisor of the home Member State or the supervisor of another host Member State information that could significantly influence the assessment of the inherent or residual risk exposure of an obliged entity in the Member State of such supervisor, including:

Information referred to in point (f) shall be provided before the obliged entity concerned has been notified of the initiation of a procedure to impose pecuniary sanctions or apply administrative measures.

relevant regulatory developments;
relevant internal and external audit findings and supervisory findings.
Other information not stipulated in paragraph 1 shall be provided by the supervisor of a host Member State on request or on its own initiative to the supervisor of the home Member State, the supervisor of another host Member State or the Authority as long as compliant with the requirement set out in Article 46(3) of Directive (EU) 2024/1640.
