Article 5 Transfers of funds within the Union
Summary What does Article 5 of the Transfer of funds regulation (TFR) say?
Article 5 operates as a derogation from Article 4, which sets out the full information requirements for transfers of funds.
Specifically, it creates a lighter-touch regime for transfers where all payment service providers in the payment chain are established in the Union.
In that purely domestic context, only the payment account numbers of the payer and payee (or a unique transaction identifier where no account exists) need to accompany the transfer, rather than the fuller set of information required by Article 4.
However, the article also establishes a mechanism by which the full Article 4 information must be made available upon request within three working days, with the depth of information required depending on whether the transfer exceeds EUR 1 000.
It also relaxes the verification obligation for lower-value transfers, unless cash or anonymous electronic money is involved, or money laundering or terrorist financing is suspected.
Important points:
- Apply a reduced information requirement when all payment service providers in the chain are Union-established, attaching only account numbers or a unique transaction identifier to the transfer.
- Respond to requests for the full Article 4 information within three working days, with the level of detail required scaling depending on whether the transfer exceeds EUR 1 000.

By way of derogation from Article 4(1) and (2), where all payment service providers involved in the payment chain are established in the Union, transfers of funds shall be accompanied by at least the payment account number of both the payer and the payee or, where Article 4(3) applies, the unique transaction identifier, without prejudice to the information requirements laid down in Regulation (EU) No 260/2012, where applicable.
Notwithstanding paragraph 1, the payment service provider of the payer shall, within three working days of receiving a request for information from the payment service provider of the payee or from the intermediary payment service provider, make available the following:
for transfers of funds exceeding EUR 1 000, whether such transfers are carried out in a single transaction or in several transactions which appear to be linked, the information on the payer or the payee in accordance with Article 4;
for transfers of funds not exceeding EUR 1 000 that do not appear to be linked to other transfers of funds which, together with the transfer in question, exceed EUR 1 000, at least:
the names of the payer and of the payee; and
the payment account numbers of the payer and of the payee or, where Article 4(3) applies, the unique transaction identifier.
By way of derogation from Article 4(4), in the case of transfers of funds referred to in paragraph 2, point (b), of this Article, the payment service provider of the payer need not verify the information on the payer unless the payment service provider of the payer:
has received the funds to be transferred in cash or in anonymous electronic money; or
has reasonable grounds for suspecting money laundering or terrorist financing.

Recital 29 Verification threshold of EUR 1 000 for transfers of funds
In order not to impair the efficiency of payment systems and in order to balance the risk of driving transactions underground as a result of overly strict identification requirements against the potential terrorist threat posed by small transfers of funds, the obligation to check whether information on the payer or the payee is accurate should, in the case of transfers of funds where verification has not yet taken place, be imposed only in respect of individual transfers of funds that exceed EUR 1 000, unless the transfer appears to be linked to other transfers of funds which together would exceed EUR 1 000, the funds have been received or paid out in cash or in anonymous electronic money, or where there are reasonable grounds for suspecting money laundering or terrorist financing.
Recital 32 Simplified information for fund transfers within the Union
In view of the Union legislative acts in respect of payment services, namely Regulation (EU) No 260/2012 of the European Parliament and of the Council(19), Directive (EU) 2015/2366 and Regulation (EU) 2021/1230 of the European Parliament and of the Council(20), it should be sufficient to provide that only simplified information accompany transfers of funds within the Union, such as the payment account number or a unique transaction identifier.
