Article 9 Transposition
Summary What does Article 9 of the DORA directive say?
This is the transposition article, setting out the obligations on Member States to bring the Directive into national law.
It establishes both a deadline for adoption and publication of the necessary national measures, and the date from which those measures must apply.
It also requires that any national measures adopted include a reference back to this Directive, and that Member States share the text of those measures with the Commission.
Important points:
- Member States are required to adopt and publish the necessary national measures by 17 January 2025, and to apply them from that same date.
- National measures adopted in compliance with this Directive must contain a reference to this Directive upon official publication.
- Member States must communicate the text of the main national measures adopted under this Directive to the Commission.

By 17 January 2025, Member States shall adopt and publish the measures necessary to comply with this Directive. They shall immediately inform the Commission thereof.
They shall apply those measures from 17 January 2025.
When Member States adopt those measures, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States.
Member States shall communicate to the Commission the text of the main measures of national law which they adopt in the field covered by this Directive.
