Article 1 Tasks of the members of the joint examination team
Summary What does Article 1 of the RTS on joint examination teams say?
This foundational article defines the full scope of tasks that members of the joint examination team are responsible for carrying out, all under the coordination of the Lead Overseer.
It establishes that the joint examination team exists to both support the Lead Overseer on an ongoing basis and to execute specific, defined oversight activities in relation to critical ICT third-party service providers.
These tasks span the entire oversight lifecycle, from planning and investigation through to inspections, recommendations, and remediation follow-up.
The article directly connects to and operationalises several key provisions of DORA (Regulation (EU) 2022/2554), acting as the practical task mandate for the joint examination team established under that framework.
Important points:
- Members of the joint examination team are required to carry out their tasks under the direction of the Lead Overseer coordinator, covering everything from drafting oversight plans to conducting investigations and inspections.
- The joint examination team must ensure relevant information about financial entities using critical ICT third-party service providers is shared with the Lead Overseer.
- Where the Lead Overseer significantly revises the individual annual oversight plan mid-year, it must involve the joint examination team in both the execution and the revision of that plan.
