Article 3 Receipt of the application for authorisation and acknowledgement of receipt

Summary What does Article 3 of the ITS on CASP authorisation say?

This article follows on from Article 2, which covers the submission of the application for authorisation as a crypto-asset service provider, and deals with what happens immediately after that submission is received.

It places a straightforward obligation on competent authorities to confirm receipt of an application and to ensure the applicant knows who is handling their case.

Important points:

  • Competent authorities are required to send an acknowledgement of receipt to the applicant, which can be done electronically, on paper, or both.
  • Competent authorities are required to include in that acknowledgement the contact details of the specific department, function, or staff member handling the application.
  • This article creates a direct communication link between the competent authority and the applicant from the outset of the authorisation process.

Springlex's summary of the article, a reading aid, not a substitute for the legal text.

Competent authorities shall send electronically, on paper, or in both forms, an acknowledgement of receipt to the applicant. That acknowledgement of receipt shall include the contact details of the department, function or staff member of the competent authority handling the application.
