Summary What does Article 2 of the ITS on competent authority information exchange say?

This article establishes the foundational infrastructure for cross-border cooperation between competent authorities under Regulation (EU) 2023/1114 (MiCA).

It sets up a contact point system, requiring each competent authority to designate a specific point of contact through which requests for cooperation and information exchange will be channelled.

This article directly underpins the procedural articles that follow, as Articles 3 through 6 all rely on these designated contact points as the primary channel for communication between authorities.

Important points:

  • Competent authorities are required to designate a contact point for cooperation and information exchange purposes, and report its details to ESMA by 15 January 2025, updating that information as necessary.
