Article 3 Request for cooperation or exchange of information
Summary What does Article 3 of the ITS on competent authority information exchange say?
This article sets out the procedural requirements for how a competent authority must submit a request for cooperation or exchange of information to another authority.
Building directly on Article 2, which established the contact point system, this article puts that infrastructure to use by requiring that all requests be directed to those designated contact points.
It also mandates the use of a standardised form (Annex I) to ensure consistency and clarity in how requests are made.
Important points:
- Competent authorities are required to submit all requests for cooperation or exchange of information in writing, by post or electronic means, addressed to the contact point designated under Article 2.
- Competent authorities must use the standardised form in Annex I when making any such request.
- Each request must specify the details of the information sought and flag, where appropriate, any confidentiality concerns relating to that information.

A requesting authority shall make a request for cooperation or exchange of information in writing, by post or by electronic means. It shall address the request to the contact point designated pursuant to Article 2.
When requesting cooperation or the exchange of information, a competent authority shall use the form set out in Annex I and shall:
specify the details of the relevant information requested;
identify, where appropriate, issues relating to the confidentiality of the information requested.
