Article 118 EBA crypto-asset committee

Summary What does Article 118 of the MiCA regulation say?

This article establishes the internal organisational structure within EBA to handle its crypto-asset supervisory responsibilities under this regulation.

It requires EBA to set up a dedicated permanent internal committee — a crypto-asset committee — specifically to prepare EBA's decisions related to the supervisory tasks assigned to it by this regulation.

This article directly supports and connects to Article 117, which confers those supervisory tasks on EBA in respect of issuers of significant asset-referenced tokens and significant e-money tokens.

Important points:

  • EBA is required to create a permanent internal crypto-asset committee to prepare its supervisory decisions under this regulation.
  • The committee's scope also covers the preparation of draft regulatory and implementing technical standards related to EBA's crypto-asset supervisory tasks.
  • EBA must ensure the committee's activities are limited strictly to crypto-asset related tasks as defined in this article.
