Article 4 Reassessment of the college composition
Summary What does Article 4 of the RTS on consultative supervisory colleges say?
This article establishes a periodic review mechanism for college membership.
Building on the criteria set out in Articles 1 and 2 of this Regulation, it requires EBA to periodically reassess whether the competent authorities currently sitting on a supervisory college still meet the qualifying criteria under the relevant points of Article 119(2) of Regulation (EU) 2023/1114.
It also places a corresponding obligation on those member authorities to cooperate with EBA's reassessment by supplying the necessary information when asked.
Important points:
- EBA is required to reassess college membership qualification at least every 2 years.
- The reassessment covers competent authorities admitted under Article 119(2), points (d), (e), (f), (h) and (l) of Regulation (EU) 2023/1114.
- Competent authorities that are members under point (l) must provide EBA with the information necessary to assess their continued qualification, upon request and without undue delay.

EBA shall reassess, at least every 2 years, which competent authorities qualify to be members of the college under Article 119(2), points (d), (e), (f), (h) and (l) of Regulation (EU) 2023/1114.
For the purpose of the reassessment referred to in paragraph 1, each competent authority that is a member of the college under Article 119(2), point (l) of Regulation (EU) 2023/1114 shall provide EBA, upon request and without undue delay, with the information necessary to assess whether those authorities continue to qualify to be a member of the college based on the criteria specified in Article 2 of this Regulation.
