Article 44 Repeal

Summary What does Article 44 of the NIS 2 directive say?

This is a brief but significant transitional article that formally repeals the predecessor legislation, Directive (EU) 2016/1148 (the original NIS Directive), replacing it with this new Directive.

It also ensures continuity by clarifying that any existing references to the old Directive should be read as references to this one, using a correlation table in Annex III to map the relationship between the two.

Important points:

  • Directive (EU) 2016/1148 is repealed with effect from 18 October 2024.
  • Any references to the repealed Directive are to be construed as references to this Directive.
  • The correlation table in Annex III governs how references to the old Directive are to be interpreted under the new one.

Springlex's summary of the article, a reading aid, not a substitute for the legal text.

  2. References to the repealed Directive shall be construed as references to this Directive and shall be read in accordance with the correlation table set out in Annex III.
