Article 38 Coordination of notified bodies

The Commission shall ensure that, with regard to high-risk AI systems, appropriate coordination and cooperation between notified bodies means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation; active in the conformity assessment means the process of verifying whether the essential cybersecurity requirements set out in Annex I have been fulfilled; procedures pursuant to this Regulation are put in place and properly operated in the form of a sectoral group means a group as defined in Article 2, point (11), of Directive 2013/34/EU; of notified bodies means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation;.

Each notifying authority means the national authority responsible for setting up and carrying out the necessary procedures for the assessment, designation and notification of conformity assessment bodies and for their monitoring; shall ensure that the bodies notified by it participate in the work of a group means a group as defined in Article 2, point (11), of Directive 2013/34/EU; referred to in paragraph 1, directly or through designated representatives means a natural or legal person established in the Union explicitly designated to act on behalf of a DNS service provider, a TLD name registry, an entity providing domain name registration services, a cloud computing service provider, a data centre service provider, a content delivery network provider, a managed service provider, a managed security service provider, or a provider of an online marketplace, of an online search engine or of a social networking services platform that is not established in the Union, which may be addressed by a competent authority or a CSIRT in the place of the entity itself with regard to the obligations of that entity under this Directive;.

The Commission shall provide for the exchange of knowledge and best practices between notifying authorities means the national authority responsible for setting up and carrying out the necessary procedures for the assessment, designation and notification of conformity assessment bodies and for their monitoring;.
