Article 30 Rules and conditions for affixing the CE marking


    1. The CE marking means a marking by which a manufacturer indicates that a product with digital elements and the processes put in place by the manufacturer are in conformity with the essential cybersecurity requirements set out in Annex I and other applicable Union harmonisation legislation providing for its affixing; shall be affixed visibly, legibly and indelibly to the product with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately;. Where that is not possible or not warranted on account of the nature of the product with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately;, it shall be affixed to the packaging and to the EU declaration of conformity referred to in Article 28 accompanying the product with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately;. In the latter case, the relevant section of the website shall be easily and directly accessible to consumers means a natural person who acts for purposes which are outside that person’s trade, business, craft or profession;.

    1. The CE marking means a marking by which a manufacturer indicates that a product with digital elements and the processes put in place by the manufacturer are in conformity with the essential cybersecurity requirements set out in Annex I and other applicable Union harmonisation legislation providing for its affixing; shall be affixed before the product with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately; is placed on the market. It may be followed by a pictogram or any other mark indicating a special cybersecurity risk means the potential for loss or disruption caused by an incident and is to be expressed as a combination of the magnitude of such loss or disruption and the likelihood of occurrence of the incident; or use set out in the implementing acts referred to in paragraph 6.

    2. The identification number of the notified body means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation; shall be affixed by the body itself or, under its instructions, by the manufacturer means a natural or legal person who develops or manufactures products with digital elements or has products with digital elements designed, developed or manufactured, and markets them under its name or trademark, whether for payment, monetisation or free of charge; or the manufacturer means a natural or legal person who develops or manufactures products with digital elements or has products with digital elements designed, developed or manufactured, and markets them under its name or trademark, whether for payment, monetisation or free of charge;’s authorised representative means a natural or legal person established within the Union who has received a written mandate from a manufacturer to act on its behalf in relation to specified tasks;.

    1. Member States shall build upon existing mechanisms to ensure correct application of the regime governing the CE marking means a marking by which a manufacturer indicates that a product with digital elements and the processes put in place by the manufacturer are in conformity with the essential cybersecurity requirements set out in Annex I and other applicable Union harmonisation legislation providing for its affixing; and shall take appropriate action in the event of improper use of that marking. Where the product with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately; is subject to Union harmonisation legislation means Union legislation listed in Annex I to Regulation (EU) 2019/1020 and any other Union legislation harmonising the conditions for the marketing of products to which that Regulation applies;, other than this Regulation, which also provides for the affixing of the CE marking means a marking by which a manufacturer indicates that a product with digital elements and the processes put in place by the manufacturer are in conformity with the essential cybersecurity requirements set out in Annex I and other applicable Union harmonisation legislation providing for its affixing;, the CE marking means a marking by which a manufacturer indicates that a product with digital elements and the processes put in place by the manufacturer are in conformity with the essential cybersecurity requirements set out in Annex I and other applicable Union harmonisation legislation providing for its affixing; shall indicate that the product also fulfils the requirements set out in such other Union harmonisation legislation means Union legislation listed in Annex I to Regulation (EU) 2019/1020 and any other Union legislation harmonising the conditions for the marketing of products to which that Regulation applies;.

    1. The Commission may, by means of implementing acts, lay down technical specifications means a technical specification as defined in Article 2, point (4), of Regulation (EU) No 1025/2012; for labels, pictograms or any other marks related to the security of the products with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately;, their support periods means the period during which a manufacturer is required to ensure that vulnerabilities of a product with digital elements are handled effectively and in accordance with the essential cybersecurity requirements set out in Part II of Annex I; and mechanisms to promote their use and to increase public awareness about the security of products with digital elements means a software or hardware product and its remote data processing solutions, including software or hardware components being placed on the market separately;. When preparing the draft implementing acts, the Commission shall consult relevant stakeholders, and, if it has already been established pursuant to Article 52(15), ADCO. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 62(2).
