Article 41 Subsidiaries of and subcontracting by notified bodies

Where a notified body means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation; subcontracts specific tasks connected with conformity assessment means the process of verifying whether the essential cybersecurity requirements set out in Annex I have been fulfilled; or has recourse to a subsidiary means a subsidiary undertaking within the meaning of Article 2, point (10), and Article 22 of Directive 2013/34/EU;, it shall ensure that the subcontractor or the subsidiary means a subsidiary undertaking within the meaning of Article 2, point (10), and Article 22 of Directive 2013/34/EU; meets the requirements set out in Article 39 and shall inform the notifying authority means the national authority responsible for setting up and carrying out the necessary procedures for the assessment, designation and notification of conformity assessment bodies and for their monitoring; accordingly.

Notified bodies means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation; shall take full responsibility for the tasks performed by subcontractors or subsidiaries means a subsidiary undertaking within the meaning of Article 2, point (10), and Article 22 of Directive 2013/34/EU; wherever they are established.

Activities may be subcontracted or carried out by a subsidiary means a subsidiary undertaking within the meaning of Article 2, point (10), and Article 22 of Directive 2013/34/EU; only with the agreement of the manufacturer means a natural or legal person who develops or manufactures products with digital elements or has products with digital elements designed, developed or manufactured, and markets them under its name or trademark, whether for payment, monetisation or free of charge;.

Notified bodies means a conformity assessment body designated in accordance with Article 43 and other relevant Union harmonisation legislation; shall keep at the disposal of the notifying authority means the national authority responsible for setting up and carrying out the necessary procedures for the assessment, designation and notification of conformity assessment bodies and for their monitoring; the relevant documents concerning the assessment of the qualifications of the subcontractor or the subsidiary means a subsidiary undertaking within the meaning of Article 2, point (10), and Article 22 of Directive 2013/34/EU; and the work carried out by them under this Regulation.
