ENRecital 92 Streamlining for public electronic communications and trust services
In order to streamline the obligations imposed on providers of public electronic communications networks means a public electronic communications network as defined in Article 2, point (8), of Directive (EU) 2018/1972; or of publicly available electronic communications services means an electronic communications service as defined in Article 2, point (4), of Directive (EU) 2018/1972;, and trust service providers means a trust service provider as defined in Article 3, point (19), of Regulation (EU) No 910/2014;, related to the security of their network and information systems means: an electronic communications network as defined in Article 2, point (1), of Directive (EU) 2018/1972; any device or group of interconnected or related devices, one or more of which, pursuant to a programme, carry out automatic processing of digital data; or digital data stored, processed, retrieved or transmitted by elements covered under points (a) and (b) for the purposes of their operation, use, protection and maintenance;, as well as to enable those entities means a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations; and the competent authoritiesas defined in Article 46 under Directive (EU) 2018/1972 of the European Parliament and of the Council(20)Directive (EU) 2018/1972 of the European Parliament and of the Council of 11 December 2018 establishing the European Electronic Communications Code (OJ L 321, 17.12.2018, p. 36). and Regulation (EU) No 910/2014 respectively to benefit from the legal framework established by this Directive, including the designation of a CSIRT responsible for incident handling means any actions and procedures aiming to prevent, detect, analyse, and contain or to respond to and recover from an incident;, the participation of the competent authoritiesas defined in Article 46 concerned in the activities of the Cooperation Group means a group as defined in Article 2, point (11), of Directive 2013/34/EU; and the CSIRTscomputer security incident response teams network, those entities means a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations; should fall within the scope of this Directive. The corresponding provisions laid down in Regulation (EU) No 910/2014 and Directive (EU) 2018/1972 related to the imposition of security and notification requirements on those types of entity means a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations; should therefore be deleted. The rules on reporting obligations laid down in this Directive should be without prejudice to Regulation (EU) 2016/679 and Directive 2002/58/EC.
