Summary What does Article 65 of the Anti-money laundering regulation (AMLR) say?

This article carves out exemptions from the beneficial ownership registration and information-holding obligations established in Articles 63 and 64.

It identifies two categories of entities that are not required to comply with those rules: certain publicly listed companies and bodies governed by public law.

For listed companies, the exemption is conditional — it only applies where control is held exclusively by natural persons through voting rights, with no other legal entities or legal arrangements in the ownership or control structure.

Artiklarna 63 och 64 ska inte tillämpas på

  1. företag vars värdepapper är upptagna till handel på en reglerad marknad, förutsatt att

    1. kontrollen över företaget utövas uteslutande av den fysiska person som innehar rösträtter,

    2. inga andra juridiska enheter eller juridiska konstruktioner ingår i företagets ägar- eller kontrollstruktur, och

  2. offentligrättsliga organ enligt definitionen i artikel 2.1.4 i Europaparlamentets och rådets direktiv 2014/24/EU(43).
