Summary What does Article 51 of the GDPR regulation say?

This foundational article establishes the requirement for supervisory authorities under the GDPR.

It places the obligation on each Member State to set up at least one independent public authority tasked with monitoring the application of the Regulation.

The article also sets the tone for how these authorities must operate beyond their own borders, requiring them to cooperate with one another and with the Commission to ensure the Regulation is applied consistently across the Union.

It connects directly to Chapter VII, which governs the cooperation and consistency mechanisms that underpin this cross-border coordination.

    1. Varje medlemsstat ska föreskriva att en eller flera offentliga myndigheter ska vara ansvariga för att övervaka tillämpningen av denna förordning, i syfte att skydda fysiska personers grundläggande rättigheter och friheter i samband med behandling samt att underlätta det fria flödet av sådana uppgifter inom unionen (nedan kallad tillsynsmyndighet).

    1. Varje tillsynsmyndighet ska bidra till en enhetlig tillämpning av denna förordning i hela unionen. För detta ändamål ska tillsynsmyndigheterna samarbeta såväl sinsemellan som med kommissionen i enlighet med kapitel VII.

    1. Om det finns fler än en tillsynsmyndighet i en medlemsstat ska medlemsstaten utse den tillsynsmyndighet som ska företräda dessa myndigheter i styrelsen; medlemsstaten ska också upprätta en rutin för att se till att övriga myndigheter följer reglerna för den mekanism för enhetlighet som avses i artikel 63.

    1. Varje medlemsstat ska senast den 25 maj 2018 anmäla till kommissionen vilka nationella bestämmelser den antar i enlighet med detta kapitel, och alla framtida ändringar som rör dessa bestämmelser ska anmälas utan dröjsmål.
