Art. 2 Provision of information to the holder of asset-referenced tokens and other interested parties | RTS on issuer complaints handling | MiCA

1. Issuersmeans a natural or legal person, or other undertaking, who issues crypto-assets; of asset-referenced tokensmeans a type of crypto-asset that is not an electronic money token and that purports to maintain a stable value by referencing another value or right or a combination thereof, including one or more official currencies; shall provide, on request or when acknowledging receipt of a complaint, clear, accurate and up-to-date written information about the complaints-handling procedure to the complainant. The information provided by the issuermeans a natural or legal person, or other undertaking, who issues crypto-assets; shall include the following:
  1. the conditions for the admissibility of complaints as referred to in Article 5(1), point (a);
  2. details of the procedure to file a complaint, including the type of information to be provided by the complainant and the identity and contact details of the person or department to which the complaint is directed;
  3. the procedure that will be followed when handling a complaint including when the receipt of the complaint will be acknowledged, indicative handling timelines and the availability of a competent authoritymeans one or more authorities:designated by each Member State in accordance with Article 93 concerning offerors, persons seeking admission to trading of crypto-assets other than asset-referenced tokens and e-money tokens, issuers of asset-referenced tokens, or crypto-asset service providers;designated by each Member State for the application of Directive 2009/110/EC concerning issuers of e-money tokens;, an ombudsman or alternative dispute resolution mechanisms;
  4. information that complaints are filed and handled free of charge with the issuersmeans a natural or legal person, or other undertaking, who issues crypto-assets; or, where applicable, with the third-party entities;
  5. a mention of the issuermeans a natural or legal person, or other undertaking, who issues crypto-assets;’s obligation to keep the complainant informed about the further handling of the complaint.

Issuersmeans a natural or legal person, or other undertaking, who issues crypto-assets; of asset-referenced tokensmeans a type of crypto-asset that is not an electronic money token and that purports to maintain a stable value by referencing another value or right or a combination thereof, including one or more official currencies; shall publish an up-to-date description of the complaints-handling procedure as well as the template for filing complaints set out in the Annex, in an easily accessible manner, including via brochures, pamphlets, contractual documents or via their website.
