Recital 115 Jurisdiction for DNS services

Where a publicly available recursive DNS service is provided by a provider of public electronic communications networksmeans a public electronic communications network as defined in Article 2, point (8), of Directive (EU) 2018/1972; or of publicly available electronic communications servicesmeans an electronic communications service as defined in Article 2, point (4), of Directive (EU) 2018/1972; only as a part of the internet access service, the entitymeans a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations; should be considered to fall under the jurisdiction of all the Member States where its services are provided.
