Recital 119 Obstacles to information sharing
With cyber threatsmeans a cyber threat as defined in Article 2, point (8), of Regulation (EU) 2019/881; becoming more complex and sophisticated, good detection of such threats and their prevention measures depend to a large extent on regular threat and vulnerabilitymeans a weakness, susceptibility or flaw of ICT products or ICT services that can be exploited by a cyber threat; intelligence sharing between entitiesmeans a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations;. Information sharing contributes to an increased awareness of cyber threatsmeans a cyber threat as defined in Article 2, point (8), of Regulation (EU) 2019/881;, which, in turn, enhances entitiesmeans a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations;’ capacity to prevent such threats from materialising into incidentsmeans an event compromising the availability, authenticity, integrity or confidentiality of stored, transmitted or processed data or of the services offered by, or accessible via, network and information systems; and enables entitiesmeans a natural or legal person created and recognised as such under the national law of its place of establishment, which may, acting under its own name, exercise rights and be subject to obligations; to better contain the effects of incidentsmeans an event compromising the availability, authenticity, integrity or confidentiality of stored, transmitted or processed data or of the services offered by, or accessible via, network and information systems; and recover more efficiently. In the absence of guidance at Union level, various factors seem to have inhibited such intelligence sharing, in particular uncertainty over the compatibility with competition and liability rules.
